Acceptable Use Policy

Introduction

Plains Internet, LLC ("Plains Internet") provides internet access services ("the Service"). The Service connects subscribers to our network and the Internet, and uses resources that are shared with other customers. Use of the Service is subject to the following rules and guidelines. Each customer is responsible for ensuring that all use of the Service on their account complies with this policy. Any user who does not agree to be bound by these terms should immediately stop using the Service and notify our support staff so the account can be closed.

Illegal activity

Using the Service for any activity that violates any local, state, federal, or international law, order, or regulation is a violation of this policy. Prohibited activities include, but are not limited to:

  • Posting or disseminating material that is unlawful, such as child sexual abuse material or obscene material.
  • Disseminating material that violates the copyright or other intellectual property rights of others. You assume all risk regarding whether material is in the public domain.
  • Pyramid schemes or other illegal soliciting schemes.
  • Any fraudulent activity, including impersonating any person or entity or forging anyone else's digital or manual signature.

Digital Millennium Copyright Act (DMCA)

Under the DMCA, copyright owners have the right to notify Plains Internet's registered agent if they believe a Plains Internet customer has infringed on their works. When we receive a complaint notice from a copyright owner, we notify the customer of the alleged infringement by providing a copy of the submitted DMCA notice. As required by law, we enforce a graduated response policy that may lead to suspension or termination of service. Our policy is to cancel internet service for any customer receiving twelve or more DMCA notices annually, and to assess a $10 administrative fee for processing each complaint after the second.

Security

You are responsible for any misuse of the Service on your account, even if the activity was committed by a friend, family member, guest, employee, or customer with access to your account. Take steps to ensure others do not gain unauthorized access to the Service. You are solely responsible for the security of any device you connect to the Service, including any data stored on it. We recommend against enabling open file or printer sharing, recommend strong passwords on anything you expose for remote access, and recommend a firewall on any always-on connection.

The Service may not be used to breach the security of another user, to access any other person's computer, software, or data without their knowledge and consent, or to attempt to circumvent the authentication or security of any host, network, or account. This includes accessing data not intended for you, logging into a server or account you are not expressly authorized to access, and probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers, or network probing tools, is prohibited.

You may not disrupt the Service. The Service may not be used to interfere with computer networking or telecommunications service to any user, host, or network, including denial-of-service attacks, flooding a network, overloading a service, improperly seizing or abusing operator privileges, or attempts to crash a host. Transmitting any information or software containing a virus or other harmful feature is prohibited.

Inappropriate content

Content available through the Internet may be offensive to some individuals or may not comply with local laws and regulations. Plains Internet does not assume responsibility for content on the Internet. You assume the risk of accessing content through the Service, and Plains Internet has no liability for claims, losses, actions, damages, suits, or proceedings arising from access to such content. You are solely responsible for any information you publish through the Service and must take appropriate precautions to prevent minors from receiving inappropriate content. We reserve the right to refuse to post or to remove any information or materials, in whole or in part, that we determine in our sole discretion to be offensive, indecent, or otherwise inappropriate, regardless of whether the material is unlawful.

We have no obligation to monitor transmissions on the Service, but we have the right to monitor transmissions from time to time and to disclose information obtained in accordance with your service agreement. By using the Service to reproduce, publish, display, transmit, or distribute content, you warrant the content complies with this policy and authorize Plains Internet to reproduce, publish, display, transmit, and distribute the content as necessary to deliver it in a timely manner.

Email

The Service may not be used to send unsolicited bulk or commercial messages, including bulk commercial advertising, informational announcements, charity requests, petitions, or political or religious messages; such messages may only be sent to recipients who have explicitly requested them. The Service may not be used to send messages to anyone who has indicated they do not wish to receive messages from you, to collect responses from unsolicited email sent from other providers, or to host any resource referenced in unsolicited email sent from anywhere. Forging, altering, or removing email headers is prohibited. You may not send numerous copies of the same or substantially similar message, send very large messages or files intended to disrupt a server or account, or propagate chain letters. Plains Internet is not responsible for forwarding email sent to an account that has been suspended or terminated; such mail is returned to sender or deleted.

Other limitations

Your use must not improperly restrict, inhibit, or degrade any other customer's use of the Service, nor place an unusually large burden on the network (in Plains Internet's sole judgment), nor restrict, inhibit, disrupt, or impede our ability to deliver and monitor the Service, backbone, network nodes, or other network services. Customers may not resell, share, or otherwise distribute the Service or any portion of it to any third party without Plains Internet's written consent.

Violations of this policy

We do not routinely monitor customer accounts for violations of this policy, but we will respond appropriately if we become aware of inappropriate use. We reserve the right to monitor bandwidth, usage, and content from time to time to operate the Service, to identify violations of this policy, and to protect the network and our customers. We prefer to advise customers of inappropriate behavior and the necessary corrective action. However, if the Service is used in a way we believe violates this policy, we may take any responsive action we deem appropriate, including temporary or permanent removal of content, filtering of internet transmissions, and immediate suspension or termination of all or any portion of the Service, without liability for those actions. These remedies are not exclusive.

We reserve the right to investigate suspected violations, including gathering information from the users involved and the complaining party, and examining material on our servers and network. During an investigation, we may suspend the involved accounts and remove material that potentially violates this policy. You authorize Plains Internet to cooperate with law enforcement in the investigation of suspected criminal violations, and with system administrators at other internet service providers or networks to enforce this policy, which may include providing the name, IP address, or other identifying information about a subscriber. Upon termination of an account, Plains Internet is authorized to delete files, programs, data, and email messages associated with the account.

Failure to enforce this policy, for whatever reason, is not a waiver of the right to do so at any time. If any portion of this policy is held invalid or unenforceable, it will be construed consistent with applicable law as nearly as possible, and the remaining portions remain in full force and effect. Federal law and Texas state law exclusively govern this policy.

Modifications

Plains Internet may modify these terms upon written notice published on this website. Continued use of the Service after such notice constitutes acceptance of the modification.
